‘Tyranny of the elected’: Why Supreme Court has flagged Election Commission appointment procedure

The Supreme Court of India is currently hearing challenges to the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023. This law, which replaced the Chief Justice of India with a Union Cabinet Minister on the selection panel for the Election Commission of India, has been criticised by petitioners for restoring executive dominance over the appointment process.
